STANDARD (NON-RESERVED) USAGE
The Rules and Regulations set forth in this document are minimum standards of usage for the Arena and Round Pen. Any violation of these standards may be reason for expulsion from the facility.
ALL USERS OF THE ARENA AND/OR ROUND PEN ARE EXPECTED TO BE FAMILIAR WITH THESE RULES AND REGULATIONS AND BY THEIR USE OF THE ARENA AND/OR ROUND PEN CONSENT TO BE BOUND TO ALL TERMS AND CONDITIONS HEREIN.
- Only residents of Woodside Park Units 1, 2, 3 and 4 who are members of Woodside Park Units 1, 2, 3 and 4 HOA and have paid their dues for the current year, and their guests (“Member” or “User”), are permitted to use the Arena and/or the Round Pen located at the Equestrian Center (“EC”) owned by WP HOA.
- The Arena and Round Pen are open all year, weather permitting. The Arena and Round Pen are not maintained by WP HOA from November through April. WP HOA is not responsible for snow removal anywhere at the EC at any time of year.
- No untrained mustangs or stallions are allowed at the facility. WP HOA reserves the right to refuse admittance to the EC to any equine, whether due to ill health, bad manners, or for any related reason.
- Users shall practice good equestrian protocol and not tolerate "bad equine" behavior. Violations shall merit expulsion from the facility.
- Use is on a first-come basis unless a reservation has been scheduled with WP HOA. If an event has been scheduled, the Arena and Round Pen are closed to Users other than those associated with the event until the event has concluded.
- No more than six equines are allowed when using the facility for any standard (non-reserved) activity. The number of Users shall be limited to two guests per one WP HOA member, with a maximum of 12 Users. The HOA member must be present at the EC at all times that his or her guests are using the facilities.
- The Arena and Round Pen shall not be considered as a common area with the Stalls Facility of the EC, which area is governed by its own Rules and Regulations.
- A User of the Arena and Round Pen is not entitled to use of the Stalls Facility unless the User is also a Tenant of the Stalls Facility under a Lease signed with WP HOA.
- A Tenant of the Stalls facility is entitled to use the Arena and Round Pen, as available, on a first-come basis.
- If an enclosure is in use and a potential User makes known his/her preference of use, the first User must relinquish the area within one-half hour of the second User's request. Users may use the facilities, undisturbed, for one hour providing a common usage is not workable among Users.
- If any User’s equine causes physical damage to any part of the EC, User must notify the Board of the damage within 48 hours of discovery of the damage, notice to be provided by email or telephone in accordance with Paragraph 9. User agrees to make all necessary repairs as soon as possible but in no event later than 15 days from notification to the Board of damage. Notice to the Board shall be mailed to WP HOA, PO Box 176, Pine CO 80470.
- No standing or sitting is permitted on the rail (pipe) fences.
- Colorado Leash Law shall apply to all dogs; no dogs are allowed near the equines.
- The consumption of alcohol and open alcohol containers are prohibited on EC grounds. The consumption of marijuana in any form and the presence and consumption of any illegal substances are prohibited on EC grounds.
- No trailers or motor vehicles are permitted to remain on the property overnight nor are they permitted in the Arena or Round Pen at any time. Written approval from the Board is required for an exception, as advised by the EC Standing Committee.
- A Member may invite a professional trainer to conduct a private lesson for that Member without being required to reserve the Arena or Round Pen. However, if not reserved (which may be done for a half day or full day), use of the Arena and/or Round Pen for an individual private lesson is on a first-come basis and is not an exclusive use. Both the Member and the trainer must comply with all of these Rules and Regulations while using the EC facilities. If a Member wishes to bring in a professional trainer to conduct a lesson for a group of riders, reservation of the Arena and/or Round Pen is required. For such reserved use, no more than six equines are allowed. The number of Users shall be limited to two guests per one Member, with a maximum of 12 Users. The Member must be present at the EC at all times that his or her guests are using the facilities.
- The Arena and Round Pen may be reserved for for-profit equine training seminars upon application to and approval by WP HOA. See separate application form/right to enter agreement.
- User hereby indemnifies and holds harmless WP HOA, its affiliates, officers, directors, agents, committee members, members, member's guests and third party service providers from any and all claims, demands, losses, damages, costs and expenses and liability (legal, contractual, or otherwise) that arise from or are in any way connected with an injury or death of persons, including, but not limited to equines being worked by User. User shall pay all costs and expenses that may be incurred by WP HOA in enforcing this indemnity, including attorney's fees.
